Presentation
of Programming
The undersigned known herein as the “Producer”
agrees that the videotape or telecast broadcast through Natick Pegasus Inc.
meets the following but is not limited to the following criteria:

The material broadcast or telecast contains no
commercial advertising material
·
The material contains no unauthorized use of
copyrighted material
The material is supported by accurate releases,
copyrights, and/or parental releases for minors.
The Producer agrees to take full responsibility for
the broadcast or telecast on Natick Pegasus Inc. and agrees to indemnify and
hold harmless, Natick Pegasus Inc. and it’s employees and Board of Directors,
the town of Natick, RCN, Comcast and Verizon. The Producer is responsible for any
claims brought on by the actions of a Producer, guests, audience members or
program content.

Use of
Equipment
The Producer understands
that all equipment is the property of Natick Pegasus Inc. for use on the access
channels. Natick Pegasus Inc. reserves the right to suspend usage of all
equipment as stated in the Policies and Procedures and the following criteria:

Equipment is used for commercial or personal
purposes
·
Producer intentionally attempts to repair or
alter settings, wiring, or attachments on Natick Pegasus equipment
Producer is responsible for all damage, beyond
normal wear and tear, to studio and field equipment while in possession of said
equipment, or while using the studio facilities and equipment. Producer is
responsible for all repair or replacement costs including shipping.

Reaffirmation
of Responsibilities
I am a member in good standing
of the
I have read, to the best of my
ability understand, and agree to follow the Rules and Procedures of NPMC,
particularly (to the exclusion of no others) that:
ü
the equipment and
facilities will be used solely for the production of local programming for
Natick Pegasus, or for activities associated with the training courses offered
there;
ü
I am thoroughly
familiar with the nature of the program material and take full responsibility
for its content;
ü
the following
material is prohibited for presentation on any access channel:
o
ANY COMMERCIAL PROGRAMMING
OR ADVERTISING
o
ANY MATERIAL WHICH
CONSTITUTES LIBEL OR SLANDER
o
ANY PORNOGRAPHY OR
OBSCENE MATERIAL OR PUBLICITY RIGHTS, AND INVASION OF PRIVACY
o
ANY MATERIALS IN
VIOLATION OF F.C.C. REGULATIONS
o
ANY MATERIAL OR
ACTIVITY WHICH VIOLATES LOCAL, STATE OR FEDERAL LAWS

I agree to obtain
all necessary clearances and permissions from all organizations and individuals
to videotape and cablecast material on the access channel
ü
In taking
equipment from the facility, or using any on-site facilities, a bailment is
created wherein I agree to take responsibility for this equipment and these
facilities with the same care as would a staff member of NPMC, including but
not limited to the avoidance of inclement weather, hazardous locations, and
security risks, especially the leaving of borrowed equipment in an unattended
motor vehicle, and the exercise of all reasonable cautions to avoid loss or
damage. In the event of such a loss or
damage, I agree to fully cooperate with the NPMC insurance carrier in any
claims investigation, and to make all necessary reports to law enforcement
authorities and NPMC, as required. I
understand that gross negligence or misconduct by me resulting in damage or
loss may require that I be held financially responsible for such loss.

I agree to hold
harmless, both severally and separately, the Town of Natick, Natick Pegasus
Inc., Comcast,Verizon and RCN, their directors, employees, or successors for any
liability, loss, claim, cost or damage of any nature whatsoever which may arise
by reason of any claim that any material cablecast or disseminated by me
infringes or violates any rights of any person or organization.
ü
Should any
equipment I have borrowed fail to operate, or operate incorrectly, I will cease
any use, and report the problem at once to an NPMC staff person. I will not make any attempt to repair or
disassemble this equipment.
Finally, by signing below, I acknowledge that I have, this date, taken possession of the equipment or
facilities enumerated on the reverse of this form, and agree to return them as
scheduled in the condition in which they were received.

VIDEO SUBMISSION
1.
I have read and am familiar with and agree to abide by the policies of Natick
Pegasus Inc.
2.
I understand that the material I submit will be used for programming on Natick
Pegasus’s Public, Educational and/or Government access channels.
3.
Presentation of the following may be prohibited:
a.
Any commercial advertising or programming
b.
Programs, which fall below minimum requirements and technical standards for
cablecast.
c.
Programming which does not have proper clearances, releases and other
assurances.
d.
Programs identified as having material that the law prohibits Natick Pegasus
from broadcasting
4.
I understand that I am fully responsible for all programming material
submitted.
5. I agree to
obtain all necessary clearances from all organizations, individuals and
groups as may be needed to videotape and/or cablecast material on access
channels.
6. I understand that I am
responsible for the production and presentations of my programs. I agree to
hold harmless RCN, Comcast and Verizon, Natick Pegasus Inc. and the Town of
